As Dubai’s real estate market evolves, the Dubai Land Department (DLD) has introduced crucial new regulations regarding the use of Power of Attorney (POA) for property transactions. What Are the New DLD POA Rules?

1. POA Validity and Attestation
Any Power of Attorney issued outside the UAE must be properly attested, presented in its original form, and must have a validity of less than two years for use in Dubai property transactions. This ensures only up-to-date and authenticated POAs are accepted, reducing the risk of fraud and disputes.

2. Payment and Fund Receipt Declarations
Declarations of receiving funds included within a POA or as a separate declaration letter are no longer accepted by the DLD. All payments related to property sales must be supported by valid proof, such as a bank transfer confirmation or a copy of a cheque. This move increases transparency and protects both buyers and sellers.

3. Manager Cheques Must Be in Owner’s Name
Manager cheques for property transactions must be issued directly in the property owner’s name as per the title deed. Cheques in the attorney’s (POA holder’s) name are no longer accepted, ensuring that sale proceeds go directly to the rightful owner.

These updates are designed to enhance security, prevent misuse of POA, and ensure that all property transactions in Dubai are transparent and in line with international best practices.
